Full Biography

Daniel Lauber is one of those rare planners who really puts his money where his mouth is. His 30–year planning career has focused on the sort of planning APA champions: ethical, inclusionary, smart planning and zoning. While often pigeon–holed by the monikers “Mr. Group Home,” “Mr. Condo Conversion,” and “Mr. Job Finder,¨ Dan also wrote the breakthrough Planning Advisory Service Report The Hearing Examiner in Zoning Administration which continues to serve as the blueprint smart communities use to establish a zoning hearing examiner process.

Three awards from APA recognize the high quality of his work. The Comprehensive Plan 1979 that Dan wrote for Oak Park, Illinois, continues to serve as a nationwide model of a solid policy plan and was the subject of a PAS Memo. In addition to his planning work, Dan has published over 12 books including the Government Job Finder. His books have won three awards.

Owner of planning and law consulting, and publishing firm, concentrating on land–use law, planning and municipal law, fair housing, and all aspects of municipal, regional, and state planning. Particular emphasis on developing land–use regulations and comprehensive plans for municipalities; representing applicants before zoning bodies; site selection and market analysis; zoning for group homes and halfway houses for people with disabilities under the Fair Housing Amendments Act of 1988 (representing municipalities and operators of community residences); housing policy and programs; and public relations and communications. Decided May 15, 1995 for the respondents. It is believed that this brief had a significant influence on the outcome of the case.

U.S. Department of Justice — expert witness on zoning and planning law issues in United States v. City of Chicago Heights, 99 C 4461. Identified legal issues that led to district court’s summary judgment decision in favor of the United States.

City of Altoona, Pennsylvania — legal consultant to draft comprehensive zoning ordinance amendments to regulate group homes, halfway houses, shelters, and other community residences in accord with the 1988 amendments to the federal Fair Housing Act (1994–1995)

Proviso Family Services: Served as attorney and expert witness in public hearing for special use permit for group home for six women with mental illness. After winning approval of Maywood, Illinois, Plan Commission, the Village Board amended the zoning ordinance to make such group homes a permitted use.

USA v. City of Chicago Heights and RFMS, Inc. v. City of Chicago Heights, Civil Action No. 89 C 4981, U.S. District Court, N.D. of Illinois. Settled in favor of RFMS, 1990. Served as legal consultant and expert witness to Rosenthal and Schanfield law firm handling Fair Housing Act lawsuit against Chicago Heights for denying special use permit for group home. Resulted in out–of–court settlement issuing special use permit for group home and $45,000+ in fines and costs.

West Meadowview Civic Association v. Kankakee County Training Center for the Disabled, Case No. 91–CH–80, 221st Judicial Circuit, Kankakee County, IL. Serving as attorney for defendant group home operator in challenge to group home based on restrictive covenant. (1991)

Community Residence Location Planning Act News, June 1990, 4 pp. and Aug. 1990, 14 pp. The June issue answers questions about the Illinois Community Residence Location Planning Act. The August issue contains model zoning provisions for each of the legal zoning approaches suggested in the compliance guidebook described above. The August issues also includes zoning recommendations for halfway house and hospices and a sample application form for administrative occupancy permits. Detailed commentary explains the why and wherefores of each zoning provision.

Recommendations to the Illinois General Assembly on Zoning for Community Residences, Jan., 1991, 44 pp. Prepared for the Illinois Planning Council on Developmental Disabilities, this report identifies proper zoning techniques and reviews the results of a state project to bring the zoning ordinances of 110 home rule municipalities into compliance with the 1988 amendments to the Fair Housing Act.
